PLDO Partner Gene M. Carlino’s article, A Review of the SECURE Act and Its Effect on Estate Planning with Retirement Asset, was published in the November/December 2019 edition of the Rhode Island Bar Journal. The article is an in-depth review of the “Setting Every Community up for Retirement Enhancement Act of 2019,” referred to as the SECURE Act, presently before the U.S. Senate after passing overwhelming by the House of Representatives. The article explains the transformative legislation’s benefits and disadvantages, the effect of the bill on a common estate planning technique used in certain sensitive situations, and offers ways to address the proposed law’s major challenges.

Devereaux provided comments and analysis to RI Lawyers Weekly in the article, Constitutional violations require new murder trial, regarding a Rhode Island Supreme Court decision that “vacated the murder conviction of a defendant who was denied his right to confront adverse witnesses in violation of the Sixth Amendment and article 1, section 10 of the state constitution.”

Vasques co-authored a comprehensive article entitled, A New Hope: Tortious Interference with an Expected Inheritance in Rhode Island, which was published in the Roger Williams University Law Review. The article details the genesis and development of tortious or wrongful interference with an expected inheritance and highlights differences in the approach states take regarding torts requirements as well as damages available to victims. It also discusses a RI Superior Court ground breaking decision that recognized for the first time in the state’s history the independent tort of tortious interference with an expected inheritance.
